The Court of Appeal sitting in Abuja has dismissed an appeal filed by Ondo State Governor, Lucky Aiyedatiwa, challenging proceedings in a suit questioning his eligibility to seek re-election.
In a unanimous judgment delivered by a three-member panel led by Justice Uchechukwu Onyemenam, the appellate court held that the trial judge of the Federal High Court acted within the law by granting the plaintiff leave to amend his originating summons in the case.
The court ruled that the governor failed to establish that the decision of the lower court occasioned a miscarriage of justice or denied him fair hearing. Consequently, the appeal was dismissed for lacking merit, with the court awarding a cost of N2 million against the appellant.
The case was instituted by Akindele Egbuwalo, who is challenging Aiyedatiwa’s eligibility to contest the next governorship election in Ondo State.
The appellate court maintained that the decision of the lower court allowing the amendment of processes was proper and did not violate any legal procedure.
